2. Purpose of the App
LumiNap is an educational and entertainment app for children aged 4 and older, featuring interactive stories and mini-tasks. The App allows users to:
- read and listen to children's stories;
- record personal voice narration (by parents);
- interact with small tasks or educational elements.
All user voice recordings are stored locally on the user's device and are never uploaded or shared with the Developer or other users.
3. Subscriptions and Purchases
The App may offer access to premium content or features through in-app subscriptions or one-time purchases. All payments are processed exclusively through the Apple App Store (on iOS / iPadOS) or Google Play (on Android). No external payment systems are used, and the Developer does not collect or store any payment or billing information.
Auto-renewing subscriptions. Where a subscription is offered:
- the subscription length, price, and any free trial period are shown on the purchase screen inside the App before you confirm the purchase;
- payment is charged to your App Store or Google Play account at confirmation of purchase;
- the subscription renews automatically for the same period and at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period;
- your account is charged for renewal within 24 hours prior to the end of the current period;
- where a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable.
Managing and cancelling. You can manage or cancel a subscription at any time:
- on iOS / iPadOS: Settings → [your name] → Subscriptions;
- on Android: Google Play app → Profile → Payments & subscriptions → Subscriptions.
Cancellation takes effect at the end of the current billing period; you keep access to paid features until then.
Restoring purchases. If you reinstall the App or change devices, you can restore previously purchased non-consumable items and active subscriptions using the "Restore Purchases" option in the App, signed in with the same Apple ID or Google account used for the original purchase.
Refunds. Refund requests are handled by Apple or Google according to their respective store policies; the Developer does not directly process refunds. This does not affect any statutory consumer rights you may have under applicable law.
4. Apple App Store and Google Play
These Terms are concluded between you and the Developer only, and not with Apple Inc. or Google LLC. The Developer (not Apple or Google) is solely responsible for the App and its content. Apple and Google are not parties to these Terms.
Additional terms for users on iOS / iPadOS (Apple App Store):
- The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
- The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (i) product liability claims, (ii) claims that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Additional terms for users on Android (Google Play):
- Your download and use of the App is also subject to the Google Play Terms of Service.
- Google is not a party to these Terms and is not responsible for the App, its content, or any claims arising from its use.
5. Acceptable Use
By using the App, you agree to:
- use it only for personal, non-commercial purposes;
- not attempt to modify, hack, decompile, or distribute the App or its content;
- not copy, reproduce, or reuse the stories, images, music, or other materials without written permission from the Developer.
The Developer reserves the right to modify, suspend, or discontinue certain features of the App without prior notice.
6. Content and Intellectual Property
All stories, illustrations, sounds, music, and other materials in the App are the intellectual property of Dmytro Antonenko and are protected by copyright laws.
Users are granted a limited, non-exclusive, non-transferable license to use the App and its content for personal, non-commercial purposes only.
Voice recordings made by parents remain their property and are stored only on the device. The Developer is not responsible for the loss of recordings due to device malfunction, app deletion, or reinstallation.
7. Privacy
The App's use is subject to the LumiNap Privacy Policy, available within the App and on the App Store / Google Play listing. LumiNap does not collect personal data from children and complies with COPPA and GDPR requirements.
8. Age and Parental Responsibility
LumiNap is designed for children aged 4 and above. Parents or legal guardians are fully responsible for supervising their child's use of the App, including subscription management and purchases.
9. Disclaimer of Warranties and Limitation of Liability
The App is provided "as is", without any warranties, express or implied. The Developer makes no guarantees regarding:
- uninterrupted or error-free operation of the App;
- loss of user data (including locally saved recordings);
- damage arising from the use or inability to use the App;
- failures caused by third-party services (such as App Store, Google Play, or Firebase).
The Developer strives to maintain a stable and safe experience but does not guarantee continuous availability or performance.
10. Termination
Users may uninstall the App at any time. The Developer reserves the right to discontinue or modify the App or specific features without prior notice.
11. Changes to the Terms
These Terms may be updated from time to time. The "Last updated" date at the top of this document reflects the most recent version. Continued use of the App after changes are published constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Ukraine. Any disputes arising from the use of the App shall be resolved in the competent courts of Ukraine.
